01
Publisher and sales process
Equilibrition is published by KESEUL, a French single-member simplified joint-stock company (SASU) with share capital of EUR 1,000, registered with the Guéret Trade and Companies Register under number 984 132 142. Registered office: 2 place de l'Église, 23460 Le Monteil-au-Vicomte, France. Contact: equil@nanocorp.com.
The payment process uses the NanoCorp platform and Stripe. The name displayed at payment or on a bank statement does not by itself establish the contractual seller. Obligations must be assigned to the seller actually identified in the order documents; this verification remains open in this document.
02
Founder Pass
The landing page presents the Founder Pass at EUR 97 as a one-time payment. It is not a monthly subscription. The announced future price of EUR 39 per month is a comparison with a future offer, not a charge automatically authorised by buying the Founder Pass.
The offer announces lifetime access to the Founder Plan, future updates to that plan, early access to new features and a direct feedback channel. The precise scope agreed at purchase and commitments already accepted must be preserved; a future feature is not deemed available today.
Tax treatment, accepted payment methods and the service delivery period must match the order summary. They are not inferred from the price on the landing page alone.
03
Commercial guarantee and refunds
The Founder Pass offer announces a 30-day full money-back guarantee. The duration of this guarantee is separate from the time allowed to make a refund after receiving a request. Its terms must respect the promise made at purchase, without retroactively adding restrictions.
Send your request to equil@nanocorp.com, identifying the email used for purchase and the order reference if available. Do not send full payment card details.
Under the commercial money-back guarantee, the refund is made no later than 14 days after receipt of the refund request. This period does not apply where the law requires an earlier refund. In particular, when the statutory right of withdrawal is exercised, reimbursement is made without undue delay and no later than 14 days after the trader is notified, in accordance with Article L. 221-24 of the French Consumer Code.
04
Three separate actions
A refund request, termination and account deletion are three separate actions. A refund request does not, by itself, constitute a request to terminate or delete the account. A termination or account deletion request does not, by itself, constitute a refund request. This distinction does not remove any statutory right to a refund.
You can request a refund without deleting your account. Account deletion must not be required before a request is considered. This distinction does not mean paid access necessarily continues after the contract is rescinded; consequences must respect the grounds for the request and applicable rights.
05
Statutory right of withdrawal
Where it applies to a consumer buying a service at a distance, the statutory right of withdrawal can generally be exercised within 14 days of concluding the contract, without giving a reason. It is separate from the 30-day commercial guarantee.
A one-time payment, beta status or opening an account does not in itself waive this right. The classification of the service and the legal conditions for any early start must be examined in the ordering process.
The procedure for exercising this right, the statutory form and the applicable online withdrawal functionality remain to be validated with the seller before these Terms of Sale are finalised. This document does not claim an unverified button or procedure exists.
06
Statutory guarantees
The commercial guarantee does not replace statutory guarantees applicable to digital services. Beta status does not remove them. Subject to the legal conditions, a consumer may in particular request that the service be brought into conformity, a price reduction or rescission of the contract.
The detailed statutory information on these guarantees must reflect the agreed period of supply. It remains to be included in the validated contractual version; this summary does not purport to replace it.
07
Account deletion and data
Permanently deleting the account at your request ends the Founder Pass attached to it; changing your email address does not. No minimum period or login frequency is added to retain access.
When the account is permanently deleted, personal data relating to its use, including notes, tasks, projects, resources and files, is deleted immediately. Account deletion is not merely archiving. Keep or request the return of information you need before deleting the account.
Account deletion does not erase invoices or records that must be retained by law. Accounting records are retained for ten years from the end of the relevant financial year. A general reference to operating the company does not justify retaining all account content. Any other retention must have an applicable basis and be limited to necessary information for a justified period.
08
Complaints and dispute resolution
You can send a complaint to equil@nanocorp.com or KESEUL's registered office. No consumer mediator has currently been designated. This must be remedied for sales to consumers; this document does not fulfil that requirement. A complaint to support does not replace consumer mediation or remove any legal remedy available to you.
Mandatory consumer protections and applicable jurisdiction rules remain unaffected. No legal remedy is conditional on a waiver or acceptance of this document.
